Direct answer

Two different questions hide inside “who owns it”. Copyright in AI-generated footage is limited: the US Copyright Office’s January 2025 report on copyrightability says purely AI-generated material is not protected, while the human creative work around it — script, selection, arrangement, editing — can be. Usage rights are a matter of contract, and those are clear: at ArcaneWiz the client receives full worldwide, perpetual commercial and broadcast use of the finished film, vesting on final payment, with music licensed for the film and no actors, locations or stock footage to clear. This article explains both, in plain words. It is not legal advice.

Companies ask this before they sign, and they are right to. A commercial is an asset: it runs on TV and at conferences, in paid media, on a website for years. So the question deserves a precise answer rather than a reassuring one. Here is the precise one.

A television commercial set with lights and a camera — in a conventional shoot, rights are a stack of releases and licences
In a conventional shoot, rights are a stack: actor releases, location releases, music and stock licences.

In the United States, the Copyright Office published Copyright and Artificial Intelligence, Part 2: Copyrightability in January 2025. Its position, in short: material generated entirely by AI from a prompt is not copyrightable, because copyright requires human authorship; but a work can be protected to the extent a human contributed creative expression — writing the script, selecting and arranging generated material, editing it into a film, adding original elements. Prompts alone are not enough; creative control over the result is what counts. Other countries differ in detail, and the law is moving.

What this means for a directed AI film: the film as a whole — its script, its structure, the selection and direction of every shot, the edit, the sound — carries human authorship. The individual generated frames may not. Nobody can honestly promise you a registered copyright in every pixel, and you should be wary of anyone who does.

2. Usage rights: what you actually need

For a company, the practical question is not “can I register it” but “can I use it, everywhere, for as long as I want, without anyone else having a claim”. That is a contract question, and it is the one a studio can answer with certainty.

ArcaneWiz terms, in plain words:

  • You receive full worldwide, perpetual commercial and broadcast use of the finished film: web, social, paid media, TV, conferences, investor meetings, internal use.
  • Rights vest on final payment. The same terms apply to one-off films and retainers.
  • Music is licensed for the film. There are no actors to release, no locations, no stock footage with its own territory and term.
  • Paid-media use is confirmed per project in the statement of work, so the licence matches the campaign.
  • Source files are available on request or as a paid add-on.
  • ArcaneWiz keeps a portfolio and showreel right for finished, released films — nothing unreleased is shown.
  • Your logo, product, trademarks and brand assets remain yours; the film does not change that.

3. Exclusivity and reuse

Finished films are made for one client and not resold. Reference sheets and generated material created for your film are not reused for another company’s film. What the studio keeps is its craft: the way it works, its templates and pipelines.

4. What to check in any AI video studio’s terms

  • Territory and term: “worldwide” and “perpetual”, or limits that will expire mid-campaign.
  • Broadcast and paid media included, or online only.
  • When rights transfer: on delivery, on final payment, or never (a licence that can be revoked).
  • Music: licensed for the uses you need, including broadcast and paid.
  • Whether the studio claims any right to reuse your film or its elements.
  • Whether any indemnity is promised; be sceptical of broad promises in an unsettled area of law.

Frequently asked questions

Who owns an AI-generated commercial?

Copyright in purely AI-generated footage is limited under current US guidance, but the human creative work in a directed film can be protected. Usage rights are set by contract: at ArcaneWiz the client receives full worldwide, perpetual commercial and broadcast use of the finished film.

Can an AI commercial be copyrighted?

Partly. The US Copyright Office (January 2025) says material generated entirely by AI is not copyrightable, while human contributions — script, selection, arrangement, editing — can be. Prompts alone do not establish authorship.

What rights does the client get from ArcaneWiz?

Full worldwide, perpetual commercial and broadcast use of the finished film, vesting on final payment. Paid-media use is confirmed per project in the statement of work; source files are available on request.

When do the rights transfer?

On final payment. The same terms apply to one-off films and retainers.

Is the music licensed?

Yes. Music is licensed for the film and its agreed uses. There are no actors, locations or stock footage to clear separately.

Can ArcaneWiz reuse our film or its scenes for another client?

No. Finished films are made for one client; reference sheets and generated material created for your film are not reused for another company’s film. The studio keeps a portfolio right for released films only.

Can we run the film on TV and in paid media?

Yes. Broadcast and commercial use worldwide are included; paid-media use is confirmed per project so the licence matches the campaign.

Do we get the source files?

Source files are available on request or as a paid add-on; the delivered master is yours to use under the full rights above.

Does ArcaneWiz indemnify us against copyright claims?

No broad indemnity is promised, because the law on AI-generated material is unsettled. The film is made from original work, your assets and licensed music, and the terms are in writing with the quote.

Is this legal advice?

No. It explains current public guidance and ArcaneWiz’s own terms in plain words. For your jurisdiction and campaign, ask your counsel.
